Terms and Conditions of Sale

Terms for the purchase of works, editions, objects, installations and optional extras sold by estructural.art.

Binding version: the Spanish text. The gallery is based in Buenos Aires, Argentine Republic, and Argentine law applies. Other languages are a reading aid; they must be checked against the Spanish original and do not replace local legal review.

I. Identity, prices and payment

Seller: estructural.art (trading name). Postal and collection address: Viamonte 572, Office 214, City of Buenos Aires, Argentine Republic. Contact: as published on the site.

The listed price is the price of the work. Unless the checkout states otherwise, it excludes taxes, duties, fees, optional insurance, framing, special packing and third-party formalities.

Payment methods enabled for a given sale (Mercado Pago, Stripe, bank transfer or another published method) are collection rails only. A collection account in Spain or in Argentina does not, by itself, move the gallery’s place of administration or the governing law.

Once payment has been credited and confirmed, preparation, recording and shipment or collection begin at once. The gallery is not responsible for delay, hold or reversal attributable to the payment processor, the issuing bank or the buyer.

II. Shipping, insurance, customs and collection

The gallery ships art. That is the priority. Dispatch is made in good faith through a first-line postal or courier service available for the route. No named carrier and no particular packing specification is guaranteed. The piece is packed so as to protect it in transit.

Insurance: where the service and destination allow, the gallery will seek transit insurance. If cover is unavailable, or if the buyer does not take it when offered, risk of loss or damage after handover to the carrier lies with the buyer.

Customs and taxes: unless collected at checkout, the price excludes export or import duty, VAT, bonds, storage, broker fees and any authority charge at origin or destination. Any cost not stated in the listed price or at checkout is payable solely by the buyer. Refusal of the parcel at destination customs does not refund the work or costs already incurred.

Collection: by prior arrangement, the buyer or a person authorised in writing may collect the work at Viamonte 572, Office 214, CABA, Buenos Aires, Argentina.

III. Made-to-measure extras, cancellations and returns

The gallery sells original art, editions, objects and installations, not fungible mass-consumer goods. After payment is credited the sale is in principle irrevocable, without prejudice to a mandatory rule of public policy that a court may be bound to apply in a particular dispute.

Frames and made-to-measure extras: if checkout offers framing or another personalised job and the order is confirmed, the workshop is instructed. That extra cannot be cancelled, returned or refunded, in any destination.

Voluntary cancellation or return, where no inescapable legal duty of full repayment applies: a charge is retained for management, packing and artistic or customs formalities, as follows:
— works up to USD 1,000: 30% of the work’s price;
— works above USD 1,000: 30% on the first USD 1,000 and 5% on the excess.
Frames and other made-to-measure extras are not refunded. Return shipping, return insurance and any cost not listed are payable by the buyer.

Any accepted return: the piece must come back in original condition, properly packed, with authenticity documents intact. A minor difference of colour or texture from the digital image, or a change of mind as to style, is not a ground for return.

IV. The work, images and intellectual property

Purchase of an original, edition, object, installation or work by an artist or craftsperson transfers title to the physical object only. The maker — and the gallery as to its own materials — keeps all reproduction, image, communication and other intellectual-property rights. Commercial reproduction without prior written consent of the gallery or the author is prohibited.

Image fidelity: the gallery publishes high-definition photographs, measurements and zoom tools, and answers questions before purchase. Screens are calibrated differently. Subtle differences of tone, brightness or texture between the display and the physical piece are inherent in seeing art as material and are not a defect, a latent fault or a wrong delivery. If the piece received is not the work sold (a different work, material original damage or a wrong title), the buyer must give notice at once.

V. Unlisted costs, governing law and venue

Any cost, tax, duty, insurance, storage, formality, return or loss not expressly stated in the listed price, at checkout or in this document is payable solely by the buyer. The gallery does not advance or refund those amounts.

Any dispute arising out of the construction, validity or performance of these terms is submitted to the Ordinary Courts of the City of Buenos Aires, Argentine Republic, with a waiver of any other venue that might otherwise apply by present or future domicile. Argentine law applies. That does not prevent a court from applying, if it must, a foreign mandatory rule of public policy; such application is neither offered nor anticipated here.

By confirming the purchase the buyer acknowledges having read and accepted these terms and the published shipping information. The version in force is the one on this page on the order date.
